Through this website, we aim to provide an interactive platform through which users can seek various services provided by us. The terms; ‘we’, ‘us’, ‘Baatcheet’, ‘the foundation’ and ‘the team’ refer to the operators of the website, i.e., The Yanai Foundation.
We understand and appreciate the trust and information you entrust upon us, and seek to protect your information to the best extent possible. We collect your information as it is essential to the provision of our Services (defined below) to you. We take your privacy seriously and will only collect, protect, use and share your information in the manner specified in this privacy policy.
The Privacy Policy (“Policy”) is a detailed guide on how we aim to protect the privacy and personal information provided by users of the Website and sets out a detailed path of how your information is and isn’t used, the usage and disclosure of this information and the safety and security measures undertaken by us to safeguard the information. - Information collected through automated means: We may also collect information about your activity on the Website, such as information about your account usage, as well as information about how you interact with the Application (collectively, “User Data”). We may combine this automatically-gathered information with other information, including Personal Information we have collected about you to enhance the quality of Services.
- Publicly shared information: The information, you chose to share on social media platforms and otherwise, not on this website, which is available to general public.
- Other information: any such information, that you chose to share with us, on you voluntary intent. In addition, we may collect demographic information such as information about your computer, hardware, software, platform, media, Internet Protocol (IP) address and connection, information about online activity such as feature usage and click paths, and other data that you may provide in surveys or through stories posted. The information collected by us is only through your activity on our website and such information as you may choose to disclose with us, from time to time, while registering for our services or in the process of availing them.
The information collected consists of you personal information and Confidential Information, also known as Sensitive Personal Information “SPI”.

We may collect Personal Information from you when you fill a registration form or otherwise voluntarily provide such information. - Sensitive Personal Information (“SPI”) means such personal information which consists of information relating to your physical, physiological and mental health condition; medical records and history; and other information. SPI collected by us shall not be disclosed to any third party without your express consent, save as otherwise set out in this Policy or the Terms of Use or as required by law. You acknowledge that in the course of your use of the Website we may receive SPI, when you choose to provide information (either through a registration form or through the sessions you may choose to attend) related to your physical, physiological condition or other such information and you hereby consent and agree to allow us to store the SPI collected in this manner in our records and disclose it in accordance with the terms of this Policy or as and when required by law. It is clarified that with respect to any SPI that you may share with us, you have the sole right to determine whether you want to share such information with us, and that you can continue to use the Website without the sharing of any SPI.
- How do we use your information?
Baatcheet may use information collected under Clause 3 above for the following purposes:
- In order to provide a personalised browsing experience, your Personal Information may be used to improve its marketing and promotional efforts, to analyse usage, improve the content of the website, product offerings, and to customise Website’s content, layout, and services, in order to improve Baatcheet with a view to optimise services for you and better tailor it to meet your needs.
- Baatcheet may track the IP address of your device and save certain User Data on your device in the form of cookies. We use this data only to deliver web pages to you upon request, to customize the Website to your interests and to measure traffic within the Application. Please note that Sensitive Personal Information provided by you to Baatcheet will not be provided to third parties without your consent. User data of a general nature such as information relating to user demographics may however be revealed to third parties.

- We use certain third-party analytics tools to help us measure traffic and usage trends for the Services. The information pertaining to your interactions shall only be accessible by the Experts and specific employees of Baatcheet in the process of providing the Services.
- Why do we retain your information?
- We may use Personal Information and other information received and collected from you to provide the Services you have requested, to enable you to access and post comments on the Website, or any part thereof, and to contact you upon your request and when otherwise necessary. We may also use Personal Information for auditing, research and analysis, and to operate and improve our Services. In certain circumstances, we may share aggregated non-personal information with third parties. When we use third parties to assist us in processing your Personal Information, we require that they comply with our Policy and any other appropriate confidentiality and security measures. - How do we collect, protect and share information you provide during a consultation?
a. Any information shared by you during personal consultation (“SPI or Confidential Information”)shall be excluded from the definition of Personal Information and shall not be collected/used in the same manner as Personal Information as mentioned in clause 3 and 5 above.
b. Your Confidential Information shall not be disclosed or shared by Baatcheet, its employees, its agents or any third party contractors, including Experts with any third party, either orally or in writing, except in the following circumstances:
- If Baatcheet, believes that there is a significant/ real/ imminent threat or risk to your health, safety or life or to the health, safety or life of any other person or the public (“Red Flags”);
- If Baatcheet, is required to share such Confidential Information to any authority by law; and
- If you have claimed a health care insurance and such Confidential Information is required by the insurer.
In case of Red Flags, Baatcheet may share your Confidential Information and Personal Information with your loved ones, the institution enabling you access to our services, or anyone in the position to offer you a helping hand, provided the same will be indicated to you well in advance.
- Confidentiality and Security
- We will protect your Personal Information and SPI and keep confidential, except where disclosure is required or permitted by law or in instances where use and disclosure thereof is permitted under this Policy.
- We follow generally accepted industry standards to protect the SPI and Personal Information submitted to us, both during transmission and, once we receive it, for storage and disposal. All information we gather is securely stored within databases controlled by us. The databases are stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information and SPI, we cannot guarantee its absolute security.
- We limit access to SPI and Personal Information to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs.
- Third parties provide certain services available on our Website and on our behalf. We may provide information, including Personal Information and SPI, to third-party service providers to help us deliver our products, information, and Services efficiently and effectively. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your Personal Information by such third parties, and we cannot guarantee that they will adhere to the same privacy and security practices as we do. - Dispute resolution
- In the event of any dispute, controversy or claim arising out of or relating to this Privacy Policy or any subsequent amendments to this Privacy Policy including, without limitation, the breach of the terms hereunder, termination, validity or invalidity thereof, or any non-contractual issues relating to this Policy (a “Dispute”), the parties shall endeavour to resolve such Disputes amicably.
- All Disputes, which are not settled pursuant to the issue resolution procedures above, will be referred and settled by final and binding arbitration by a sole arbitrator mutually appointed by the parties in accordance with the Indian Arbitration and Conciliation Act, 1996 as amended from time to time, and the seat of arbitration shall be at Delhi.
- Governing law and jurisdiction
This Policy and information contained herein, shall be governed by the laws of the Republic of India. Subject to the Clause 13 The courts of Delhi, India shall retain exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of or in relation to the terms of Privacy Policy.

Donations
- Baatcheet currently accepts donations from: (i) Indian citizens and organisations registered in India; (ii) Overseas Citizens of India (OCI) / foreign nationals; and (iii) organisations registered outside India, through various channels for donations made available on the Website and through other accepted channels. To this effect, if you wish to donate to Baatcheet, you will be asked to supply certain compliance-related documentation including your Permanent Account Number or any other similar identification details applicable in your territory. However, this information is not stored on our servers and will be stored on a third-party website.
- If you wish to use the ‘gift a donation’ feature on the Website, we may collect Personal Information of a third party, limited to the name and email address of such third party, for the purpose of issuing a ‘thank you’ note for the donation made by you on behalf of the third party (“Third-Party Information”). You agree that you are solely responsible for the permissibility of usage of the Third-Party Information, and Baatcheet will not be liable for any claims arising out of the use of the Third-Party Information.
- Anonymous donations will not be accepted. You agree that all information that you provide for the purpose of making a donation will be accurate, complete and current. Once you donate, you agree to fully complete and fulfil the obligations that arise out of your participation in donation / payments on the Website. You agree to pay all charges incurred by authorized users of your account and credit card or other payment mechanism at the prices in effect when such charges are incurred, to Baatcheet, through its bankers / credit card companies. You will also be responsible for paying any applicable taxes, if any.
You understand that donations once made cannot be charged back, except in cases of fraudulent use, once investigation is carried out by necessary governmental / bank authorities and proof substantiated. In case any donation receipt is issued against the same, that shall stand cancelled, and any income tax benefit so derived shall be null and void. Please note that with regard to any donations made to Baatcheet, the acceptance of the same is at the sole discretion of Baatcheet. Baatcheet reserves its sole rights to accept or reject any donation without assigning any reason thereof, with full money being refunded to the applicant.
